Can i take court help if my DDO do not give necessary deduction WITHOUT REASON?

i claimed tax deduction under sec 80DD by submitting all documents and income tax circulars.my DDO asked me take refund after filing IT return,refund is taxable.can i take court directive against my DDO or refund is the only option
